InstaAstro - Terms And Conditions For Users

These Terms and Conditions of Use (hereinafter referred to as “Terms of Usage”) outline and regulate the access and use of the services and content provided by InstaAstro Private Limited (hereinafter referred to as “InstaAstro”, “We”, “Us”, or “Our”) through its digital platforms, including but not limited to www.instaastro.com, mobile applications, and any other associated services (collectively referred to as the “Platform”).

UPDATES & USER RESPONSIBILITY

InstaAstro holds the rights to modify/update/amend the Terms of Usage at any given time. It is duly stated that the users are responsible for checking the Terms and Conditions policies to remain in compliance with the terms. No notice of such update or modification shall be sent to a User or a Registered Member, and such User or Registered Member is required to visit the Website periodically to keep updated with these Terms.

By accessing or using the InstaAstro Platform, you (“User”, “You”, “Your”) acknowledge that you have read, understood, and expressly agree to be bound by these Terms of Usage. If you do not agree with any part of the Terms of Usage, you are advised not to proceed further or click on the “I AGREE” button. We strongly recommend that you read these Terms of Usage carefully before registering on the Website or accessing any content, information, or services provided via the Platform. Your continued use of the Platform, even after any modifications or updates to the Terms, shall be deemed as your acceptance of the updated Terms and your agreement to be legally bound by them.

GENERAL DESCRIPTION & ACCEPTANCE OF TERMS

These Terms of Usage describe and regulate the scope of Services provided to a User by INSTAASTRO TECHNOLOGY PRIVATE LIMITED through instaastro.com and mobile application (“We”, “us”, “our”, “InstaAstro” “InstaAstro Application”).

This Website is designed to provide users with access to astrological consultation services through audio, video, or written correspondence in the form of reports (“ Service(s)”) via its Website and Mobile Application (“Website”). The scope of these Services is described in detail in these Terms. This Website provides a variety of services, some of which are accessible to the User upon payment of a designated fee (“Paid Services”). In contrast, others are available free of charge (“Free Services”).

The Terms of Usage is an electronic agreement between the User (' User', 'you', 'your') and InstaAstro. You are advised to read these terms carefully before accessing any information, Service, or other content on the Website.

We publish this document in compliance with:

Section 43A of the Information Technology Act, 2000 and
Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011.
By accessing the Website, you unconditionally consent to these Terms of Usage and agree to be bound by them legally. If these Terms or any part thereof seem unacceptable to you, we recommend that you refrain from using the Website.

We reserve the right to stop providing you with Services through our Website or to change, alter, modify, or refine them without providing prior notice. Your inability to access our Website at any time shall not impose any legal liability on us. Additionally, we reserve the right to limit your access to all or any portion of the Website.

SERVICES OFFERED

The Services provided by us include but are not limited to astrological content, reports, tarot card readings, face readings, palmistry, life coaching, counselling in the Services offered, numerology, predictions, live telephone consultations, email consultations, or products sold through our shopping platform, including but not limited to gemstones, rudraksh, etc. InstaAstro does not warrant the reliability of any consultation provided to a User or a Registered Member.

The Services Provided by us are classified into two categories, i.e., Free Services and Paid Services. The nature of each Service and the amount payable by a User for access to such Service, if any, shall be visible to the User on the Website.

Our Free Services are available to everyone who visits our Website. However, to use our Paid Services, a User shall be required to complete the registration process on the Website (“Registered Member”). A Registered Member accessing any Paid Service shall be required to provide us with updated and accurate information as prompted on the Website and to inform us of any changes to such information to ensure better output.

REGISTRATION, ACCOUNTS, & SECURITY

InstaAstro’s Services are available only to individuals who are competent to contract as per the Indian Contract Act 1872. The following are the eligibility criteria and guidelines for all users of InstaAstro’s Services:

By using the InstaAstro platform, you confirm that you are 18 years or older and legally capable of entering into a binding agreement under the Indian Contract Act, 1872. InstaAstro is not responsible for any misuse of its services by individuals, including minors. However, users may seek guidance related to minors in their family in line with these terms.
Services on the platform may be offered either by InstaAstro or through third-party experts. While we strive to protect your personal and payment information, no digital platform is entirely risk-free. Despite security measures, there may be minimal risks like fraud or data misuse beyond our control.

The use of our platform is not permitted if:

You reside in a region where such services are legally restricted.
Religious or legal norms prohibit your participation.
You operate multiple accounts with different mobile numbers.

Every User unconditionally consents to us perusing the information provided by such User or Registered Member in order to ensure, maintain and provide our Services to the best of our ability and for grievance redressal if need be. Users agree to receive communications from InstaAstro, including newsletters, information updates, notifications, and promotional messages, through SMS, email, WhatsApp, and other channels.

Registration As A “Member”

To use our Paid Services, you shall be required to create an account with us to become a Registered Member. The registration process may require you to provide us with current and updated personal information, including, but not limited to, your phone number, email address, date of birth, and other information as prompted on the Website during the registration process.

The registration process shall require you to share with us a One Time Password (“OTP”) that the User shall receive on the phone number provided by him/her during the registration process.

An account can be created by other login methods through the User’s Gmail login information. No User can have more than one valid account registered with a single phone number.

InstaAstro’s Right To Suspend A User Account

InstaAstro does not independently verify the veracity of the information provided by a User or Registered Member and shall assume no liability arising out of any inaccuracy in the data provided to User, or Registered Member on the basis of such information.

Further, InstaAstro reserves the right to temporarily or permanently suspend the account of a Registered Member or restrict his right of usage of certain Services or their access the Website, without giving any prior notice to such Registered Member, in the event that the information provided by such Registered Member is found to be inaccurate or in the event the Registered Member is found to have indulged in making defamatory statements against or regarding InstaAstro, its employees, officers, agents, affiliates or regarding the Services provided through the Website.

Security of Registered Members’ Account

The account of a Registered Member is protected by means of a username and password ('Login Information') known only to the Registered Member at the time of registration of the account, and such Login Information should not be shared with anyone else. Each Registered Member is responsible for maintaining the confidentiality of their Login Information, and every Registered Member agrees to immediately notify us of any unauthorised use of their Login Information or any other breach of security.

The Registered Member is solely responsible for the security and confidentiality of his/her payment accounts linked to his/her registered account on the Website. InstaAstro shall bear no responsibility in case of any unauthorised use of such linked payment account by a third party. Further, any such unauthorised use, which a Registered Member is aware of or suspects, should be reported to us without any unreasonable delay.

It shall be the sole responsibility of a Registered Member to log out of their account after the completion of a session and any loss or damage of whatsoever nature caused due to failure to follow the said procedure shall be borne by such Registered Member alone and InstaAstro shall not, in any way be held liable for any consequential loss or damage.

No User shall copy or modify the technology and software associated with the Website. Further, the Users accept not to rent, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to any one of the associated technologies and software owned or used by the Website.

Users agree not to disrupt, overburden, aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support the Website; or (b) the enjoyment of Services by any other User. Any unauthorised access to the Registered Member’s Account, servers, or networks associated with the Website’s Services by any means except as provided by InstaAstro shall be deemed to constitute a breach of these Terms.

No User shall indulge in activities like circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software associated with the Services

The User accepts, agrees, and acknowledges that he/she will neither support nor conduct any sort of attack, including (but not limited to) distribution of a virus, denial of service, or other attempts to interrupt the Services provided by the Website.

COMMUNICATION WITH ASTROLOGERS

InstaAstro’s Services also include consultation with various astrological experts (“Astrologers”) who have enrolled with InstaAstro to provide consultation to our Users via electronic mediums, including but not limited to phone calls, video calls, texts, etc. Your consent to these Terms also constitutes your consent to us arranging a consultation call with such Astrologers should you choose to avail of a Service that requires such telephonic consultation.

The Astrologers enrolled with us are prohibited from sharing their personal details like contact number, email, social media username, address, etc, with any User and are also prohibited from indulging in or suggesting activities such as black magic, vashikaran, or suggesting any pooja using these tantras.

The Users hereby agree to promptly inform InstaAstro of any violation or attempt at a violation of such Terms by an Astrologer. Failure on the part of a User or a Registered Member to furnish such information may lead to a temporary suspension of the Registered Member’s account or restriction on such User to access the Website as the case may be.

First Call/Chat At Rs. 1 (INDIAN USERS)

InstaAstro offers every new user a first chat or call session at just ₹1. Upon successfully recharging ₹1, users will receive ₹100 in wallet credits to explore our astrology services.

This offer is applicable only to first-time users whose mobile number and device ID have never been registered on InstaAstro before.
The ₹100 free wallet credit is valid only within the InstaAstro platform and cannot be withdrawn or transferred.
Only one ₹1 recharge offer is permitted per user. Multiple registrations to abuse the offer may result in suspension or removal of benefits.
InstaAstro reserves the right to modify, pause, or revoke this offer at any time without prior notice.

First Free Call/Chat (INTERNATIONAL USERS)

InstaAstro offers a one-time free consultation via chat or call—lasting between 1 to 5 minutes—to each unique user for trial and exploration purposes. A “unique user” is defined as an individual whose mobile number and device ID have not been previously registered or used to access InstaAstro services.

This free session is non-transferable and subject to availability.
InstaAstro reserves the right to withdraw or modify this offer at any time without prior notice.
Abuse of this policy, including attempts to create multiple accounts using different credentials or devices, will result in immediate suspension and disqualification from future offers.

WEBSITE CONTENT

The InstaAstro website, along with any external pages linked through it, is owned and operated as private property. All user activity on the platform, including consultations with registered astrologers or third-party advisors, must fully comply with these Terms of Usage.

Users must not share, upload, or transmit any content that is unlawful, harmful, invasive, offensive, vulgar, or infringes upon the rights of others. Any such violation may lead to account suspension, denial of access, or permanent removal from the platform, as determined by InstaAstro.

We reserve the right to modify or discontinue any element of the platform at our discretion—this includes features, design elements, deals, offers, or informational content—without prior notification.

Except for direct consultations with verified service providers, all other material on the platform—including educational articles, visuals, or general content—is intended for informational purposes only. Such content must not be interpreted as medical advice. InstaAstro neither offers nor guarantees any medical outcomes and does not validate any recommendations, treatments, or medications suggested by third-party experts.

If any unexpected outcome occurs after using the services, InstaAstro or its associated advisors shall not be held liable. The platform makes no assurances regarding the results users may expect after availing consultations. Users engage with the platform and its services at their own discretion and risk.

By continuing to use InstaAstro’s services, you acknowledge that any dispute or claim arising due to the conduct, advice, or negligence of a service provider or external party must be pursued directly against that individual or entity. You agree not to hold InstaAstro accountable for such issues or seek legal redress from the platform itself in those matters.

USER ACCOUNT ACCESS

To uphold service quality and provide prompt support, InstaAstro reserves the right to access user accounts and associated data. By creating an account, you grant InstaAstro, including its authorised team members and representatives, full access to your account information when required.

This access is intended for resolving user concerns, maintaining platform integrity, and investigating any complaints or suspected misuse on a case-by-case basis using available data. Users are encouraged to review our Privacy Policy for detailed information on how such data is handled and protected.

PRIVACY POLICY ACKNOWLEDGEMENT

By accessing or using InstaAstro’s Website or services, the User expressly agrees, acknowledges, and provides full consent to the terms outlined in InstaAstro’s Privacy Policy, available at www.instaastro.com. This Policy clearly defines how we collect, use, store, release, and process data—whether in whole or in part—through various platforms and channels.

Our Privacy Policy reflects our commitment to protecting your confidential and valuable information, including details collected via Google login and payment information. The User acknowledges having read, understood, and accepted the Privacy Policy, including any updates or modifications that may be periodically published on the Website.

BREACH & TERMINATION OF ACCOUNT

InstaAstro reserves the right, at its sole discretion, to modify, alter, discontinue, or suspend any part of its services or User accounts—either partially or entirely—without prior notice or obligation to provide reasons. This includes, but is not limited to, changes in services ordered, suspension of access, or termination of Registered Member or Service Provider accounts.

In the event of a violation of any terms mentioned in the Terms of Usage or Privacy Policy, InstaAstro holds the right to take immediate action, which may include:
Blocking, restricting, or permanently terminating the User’s or Registered Member’s access to the Website;
Deactivation of the Service Provider’s (including Astrologers) profile for breach of Terms of Usage or their agreed Service Terms & Conditions;
Refusal to authenticate or verify the information provided at the time of registration or during usage.
Discovery that the User or Member has submitted false, misleading, or fraudulent data;
Any actions from a User or Member that may potentially cause legal liability to InstaAstro, its affiliates, service providers, or other Users.
Any interference with Website functionality, violation of InstaAstro’s Privacy Policy, or disruption to other Users’ experience.

Account Deactivation & Data Retention

Registered Members may request account deactivation at any time by writing to us at support@instaastro.in.

Upon termination—whether initiated by the User or by InstaAstro—we reserve the right to retain the User's information for a period of [insert retention period], solely for internal record-keeping and legal purposes. All such retained information will be automatically deleted after the specified period.

REFUND, CANCELLATION AND DELIVERY POLICY

Refunds for Services

InstaAstro strives to offer quality astrological services. However, under certain conditions, a refund may be considered, entirely at the discretion of InstaAstro. Refund requests will only be entertained if:
There is a network issue that disrupts the chat or call session (e.g., dropped connection, background noise, inaudible consultant).
The Astrologer is unable to respond fluently in the language listed on their profile.
The Astrologer takes inordinately long to respond or replies with irrelevant/inappropriate content.
The Registered Member is dissatisfied with the quality of the consultation. In such cases, a refund will only be considered after an internal quality audit, and the final decision of InstaAstro shall be binding and non-contestable.

Note: No refund shall be granted for dissatisfaction related to the accuracy or outcome of predictions.

Refunds Will NOT Be Issued If:

The consultation has already begun, or the service has been executed.
The refund request is made more than 2 hours after payment.
Incorrect or incomplete information is provided by the User.
The service (including report generation) is already in the processing stage.
A wrong contact number is provided for telephonic services, and the call gets connected.
The service was availed in a hasty or careless manner.
The User has already received a consultation report or used any electronic feature.
The service ordered includes printable items (e.g., Horoscope, Trikal Samhita, Janam Patri, etc.).

Cancellation of Orders

A User may request cancellation within 1 hour of placing an order before processing begins. Whether a refund is approved in such cases will be at the sole discretion of InstaAstro.
InstaAstro reserves the right to cancel any order due to non-availability, pricing errors, or other technical issues. If payment has been made, the amount will be refunded to the User’s InstaAstro Wallet.

Product Return & Refunds

No refund shall be entertained for damaged products once delivered. Users are advised to handle the products carefully post-delivery.
InstaAstro does not ship physical products outside India.
Refunds will only be considered if:
The product is damaged during transit.
A product unpacking video is provided by the User as proof.
The refund request is made within 2 days of receiving the product.

Multiple Payments & Transaction Errors

If a User makes multiple payments for the same service, the additional amount will be refunded in full without deductions.
Refunds for technical glitches (e.g., payment gateway timeout) will be issued after verification.
Users must ensure their bank hasn’t been debited before retrying payment.

Refund Processing Timeline

All refunds will be processed within 7–10 business days from the date of approval.
Refunds, once approved, will be credited to the User’s InstaAstro Wallet only.
Refunds may be subject to deduction of bank charges, payment gateway fees, and shipping/custom fees wherever applicable.

USER RESPONSIBILITY

By using the InstaAstro Website, Services, or Mobile Application, all Users—including Registered Members and Service Providers (e.g., Astrologers)—agree to abide by the following responsibilities and obligations:

Lawful Use

The User agrees to use the Website and its services only for lawful and personal purposes.
The User shall not engage in any activity that is prohibited under applicable laws, including but not limited to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Accurate Information

The User must provide true, accurate, complete, and updated information during registration or service usage.
Providing false, misleading, or fraudulent information may result in account suspension or termination.

Respectful Conduct

The User agrees to maintain respectful behaviour while interacting with InstaAstro representatives, including Astrologers.
Unreasonable, abusive, or harassing behaviour may lead to immediate deactivation of services and forfeiture of wallet balance.

Prohibited Content

Users must not host, upload, transmit, or share any content that:

Belongs to another person without authorisation.
Is defamatory, obscene, offensive, pornographic, or promotes hate or harm.
Infringes any intellectual property rights (e.g., copyright, trademark).
Deceives, impersonates, misleads, or violates the privacy or public order.
Contains malware, harmful code, or any form of computer virus.

Platform Misuse

Users shall not:

Attempt to gain unauthorised access to any part of the Website or its systems.
Interfere with or disrupt the Website’s services or servers.
Collect email IDs or personal data of other users for unsolicited communication.
Send spam, chain letters, or promotional material without consent.
Reverse engineer, copy, distribute, or commercially exploit any content from the Website without written permission.

Responsible Communication

Users agree not to transmit unlawful, abusive, vulgar, or objectionable material via any communication feature on the Website.
The User agrees not to encourage or participate in any conduct that may result in legal liability.

Reporting Abuse

Users are encouraged to report any misuse or violation of the Website’s Terms, Privacy Policy, or services.
False or malicious complaints may result in immediate suspension without refund.

Compliance & Penalties

Users must comply with all terms and applicable laws. Repeated violations may lead to warnings, suspension, or a permanent ban from the platform.
Any balance in the User’s Wallet, if applicable, shall be refunded after deducting charges related to the violation.
InstaAstro reserves the right to refuse service to any User found violating these obligations.

Communication Consent

By using InstaAstro, the User agrees to receive service-related communication through email, SMS, in-app notifications, and WhatsApp Business messages.

BANKING & PAYMENT INFORMATION

All payments for accessing Paid Services on the Website must be made exclusively through the Registered Member’s InstaAstro Wallet, linked to their account. To add funds to this Wallet, the Registered Member must use valid banking methods such as debit/credit cards, net banking, or UPI.

By initiating a payment or depositing money into the InstaAstro Wallet, the User expressly agrees and warrants that:

The banking details provided (debit/credit card, UPI, or net banking) are accurate and valid, and the User is legally authorised to use such payment instruments.
The User shall not use any card or account that is not lawfully owned or authorised for use by them.
The User confirms that they are fully entitled to use the provided card or bank account for transactions on the Website.
It is the User’s responsibility to ensure sufficient balance or credit is available at the time of initiating the transaction.
All payments must be made in a timely manner to cover applicable dues, fees, or charges as per the services selected.

In case of any discrepancy, false information, or unauthorised use of payment details, InstaAstro reserves the right to take necessary legal or remedial action, including suspending or terminating the User’s access to services.

If any provision of these terms related to payments or banking information is found to be unenforceable under applicable law, such provision will be replaced with a valid one that closely reflects the original intent. All remaining provisions will continue in full force and effect.

REPRESENTATION & WARRANTIES

All Services provided to Users and Registered Members through the Website and/or App are delivered on an 'as is' and 'as available' basis unless expressly stated otherwise in writing. InstaAstro disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Except where explicitly specified, InstaAstro makes no representations or warranties that:

The Website or App will be continuously available without interruption or free of errors.
The information presented is complete, accurate, non-misleading, or true in every respect.
The servers, systems, content, software, or services provided via the Website or App are free from viruses, malware, or other harmful components.
Any advice, prediction, or service provided constitutes legal, medical, or professional advice.
Any errors or defects will be corrected.
The use of the Website or App will meet your expectations or requirements.
The Website shall be liable for loss, misuse, alteration, or unavailability of User information.
The outcomes of astrological or spiritual services will be accurate, effective, or reliable.

Astrological counselling provided through InstaAstro is based on the individual knowledge, experience, and interpretation of astrologers and service providers, and therefore, advice may vary from one provider to another. The Website does not guarantee the accuracy or efficacy of any recommendation made by the astrologers, including the use of gemstones, yantras, mantras, rituals, or other remedies.

Every User and Registered Member is solely responsible for fully and truthfully disclosing their emotional, mental, and physical condition to the astrologer to enable them to provide informed guidance. Any decision taken by a User based on such advice is done entirely at their own risk.

The Website is not a helpline platform for suicide prevention. Users experiencing suicidal thoughts are strongly advised to seek immediate help by contacting relevant police authorities, medical professionals, or certified suicide prevention helplines such as AASRA (+91-22-27546669).

LIMITATION OF INSTAASTRO’S LIABILITY

To the maximum extent permitted by law, InstaAstro and its affiliates, officers, directors, agents, licensors, and employees shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of:

The use of or inability to use the Website, App, or Services;
Any error, omission, or inaccuracy in the data, content, or materials provided.
Delay or interruption in operation or transmission.
Unauthorised access to or alteration of your transmissions or data.
Statements or conduct of any third party on the Website, including astrologers or service providers.
Any contract or interaction independently entered into between a User and an astrologer outside the scope of the Website.

Users acknowledge that astrologers and service providers are independent members of the Website and are not employees or agents of InstaAstro. While InstaAstro performs a limited review of the credentials of service providers, it does not endorse, recommend, or warrant the accuracy, completeness, or validity of their advice or content.

The Services offered, including but not limited to astrological readings, tarot, numerology, fortune-telling, spiritual products, and live consultations, are intended for entertainment purposes only. Any reliance placed on such Services is solely at the discretion of the User.

InstaAstro does not claim to be a medical institution, nor does it guarantee the validity or outcome of any health-related advice provided by astrologers. Users are strongly encouraged to consult qualified medical professionals for any physical, emotional, or mental health concerns.

The Website disclaims any responsibility for unauthorised use of your account, whether known or unknown to you. Any content downloaded or obtained through the use of the Website is accessed at the User’s own risk, and the User shall be solely responsible for any resulting damage to their system or data loss.

InstaAstro shall not be liable for typographical or pricing errors, including those that affect the validity of discount coupons or promotions. The Website is not liable for any delay, suspension, or failure of its functions due to technical issues or reasons beyond its control.

InstaAstro’s liability in any situation, regardless of the form of action, shall at all times be limited to the amount paid by the User or Registered Member to InstaAstro for the specific Service giving rise to the claim. No oral or written communication or advice provided by InstaAstro shall constitute any warranty not expressly stated in these Terms of Use.

INDEMNIFICATION

You agree to fully indemnify and defend InstaAstro, along with its affiliates, employees, directors, officers, agents, and representatives, from and against any and all claims, liabilities, losses, damages, expenses, or legal proceedings (including reasonable attorney fees) arising from:

Your use or misuse of the InstaAstro platform and services, including any breach of your obligations under these Terms of Usage.
Any third-party claims related to actions taken by you on the platform, including violations of our Privacy Policy, infringement of intellectual property, or damage caused to another user or party.
Legal disputes involving content originality, copyright concerns, or violation of property, privacy, or other third-party rights resulting from your conduct or content shared via your account.

This indemnity applies regardless of whether the claims are brought directly against InstaAstro or through a third-party dispute resolution process.

OWNERSHIP & INTELLECTUAL PROPERTY

All content made available on the InstaAstro platform—including text, images, audio, video, software, visuals, promotional material, and third-party advertisements—is protected under applicable intellectual property laws, including copyrights, trademarks, and patents.

Users are prohibited from reproducing, distributing, modifying, or publicly displaying any content from the platform unless they have received formal written permission from InstaAstro or the rightful content owner.

Some visual or design elements (such as images or icons) may be sourced from publicly available platforms like Google Images. InstaAstro does not claim ownership of such content and disclaims liability for any copyright issues that may arise from their use.

NOTICES

Unless expressly stated otherwise, all notices to InstaAstro shall be in writing and shall be sent via email or through the post. The rules concerning the communication of acceptance under the Indian Contract Act 1872 shall apply to the receipt of a notice sent by a User, Registered Member, or the Website. Notices to a Registered Member shall be sent to the email address provided during the registration process. Notices to the Website, if sent by post, shall be sent at the following address:

CONTENT DISCLAIMER

At InstaAstro, we are committed to providing a respectful and secure space for our users. To maintain integrity across our platform, we strictly prohibit certain types of harmful or inappropriate content. Violation of these guidelines may lead to immediate account suspension or permanent deletion.

Sexual Content & Inappropriate Material
